General Provisions
Firstly, it is specified that the term 'Company' refers to the Cap Corse Croisière company.
The purchase of a ticket constitutes acceptance of these general terms and conditions, which passengers are deemed to have read. Ignorance of these conditions does not exempt their application. The Company's liability cannot be extended beyond these general terms and conditions.
Article 1: Reservations
The Company accepts reservations via its website cap-corse-croisiere.fr, by telephone, as well as at our sales counter.
For any reservation made by phone or at our sales counter, a handling fee of two euros (€2) will apply additionally.
The client will be required to make payment for their ticket following this reservation under the conditions outlined in Article 4 herein.
Any specific health conditions must be declared at the time of booking, as stated in Article 5 of these general terms and conditions.
The company is not authorized for the transport of passengers with reduced mobility.
Seating is not assigned or allocated. Seats for passengers absent 10 minutes before departure are allocated to waiting passengers. Tickets are valid for the date and time of the reserved service within the operating season of the current year. Tickets are personal, non-transferable, non-modifiable, non-refundable, and subject to cancellation conditions.
Article 2: Schedules, Routes, and Excursion Rates
The company offers its passengers several circuits throughout the day at different rates. Schedules and routes are defined by the company. The website, as well as brochures, panels, and advertisements published by the company presenting the excursion routes, do not constitute a contractual document. The information provided therein is indicative.
Programs may be subject to changes. Changes to schedules and routes may occur during the season based on weather conditions, felt temperature, sunrise and sunset times, or the opening hours of establishments that may accommodate passengers as part of the proposed excursions (port, restaurant, etc.). Similarly, rates may vary at any time based on various factors or economic circumstances (surcharge, fuel, etc.) or changes in taxes (VAT, port and usage taxes).
Passengers will be informed of schedules, routes, and rates at the time of their reservation via the website or after contacting the Company for information. However, departure and arrival times announced at the time of booking may be advanced or delayed in the event of any difficulty encountered by the ship's captain. Additionally, weather conditions may require the captain to modify the originally planned excursion route. In such cases, the excursion rate will be adjusted. In any case, passengers will be informed of any changes to schedules, rates, or routes. In no event shall such a modification justify the payment of any compensation to passengers.
Article 3: Cancellation
3.1 Cancellation by the company
The company reserves the right to cancel an excursion without notice or compensation if the minimum passenger quota is not reached (8 full-fare adult passengers), in case of force majeure, fortuitous event, adverse weather conditions, breakdown, malfunction, for safety reasons, or for any other legitimate reason.
The company will endeavor to offer an alternative to passengers, including rescheduling the excursion, based on the company's availability, without passengers being entitled to any compensation or indemnity.
In the absence of a proposed or accepted alternative solution, passengers may claim a full refund of their tickets from the company.
3.2 Cancellation by the passenger
Tickets are neither exchangeable, nor modifiable, nor refundable.
The company offers the option of purchasing a paid insurance service (MEETCH) at the time of ticket purchase. The customer has received information on coverage terms and limits of guarantees. The customer is free to choose whether or not to purchase this cancellation insurance.
In the event that the customer decides to purchase cancellation insurance through an external provider (MEETCH), the terms and conditions of that provider will apply. Otherwise, the passenger will be required to pay for their ticket in full, and the company will not be liable for any refund or compensation.
Article 4: Accepted Payment Methods
The company accepts payment by credit card, cash, or bank transfer. Payment for the ticket is made at the time of booking. Tickets are issued only against full payment. The company no longer accepts payment by check.
Article 5: Health Status
Passenger Health Status
Any specific health condition must be declared at the time of booking. Additionally, any passenger with a disability, a proven health problem, or physical conditions incompatible with the proposed excursion (hernia, osteoporosis, etc.) must notify the company at the time of booking.
Pregnant Women
This type of boat is not recommended for pregnant women and is prohibited from 5 months of pregnancy onwards. Furthermore, depending on marine weather conditions, the Company reserves the right to refuse boarding to pregnant women. In case of doubt, consult your doctor before booking.
Passengers with Disabilities:
The company is not authorized for the transport of passengers with reduced mobility.
We recommend that passengers with disabilities notify us before purchasing their ticket to determine the feasibility of boarding. In case of non-declaration at the time of booking, the Captain may refuse boarding to passengers whose health condition is not compatible with the excursion without any refund or compensation. This passenger will still be required to pay for their ticket, and no refund or compensation will be provided.
Article 6: Boarding
Boarding and disembarking of passengers take place in the presence of the captain, who directs passengers and indicates the procedure for boarding and disembarking.
Conditions
Passengers must arrive at the boarding area 15 minutes before departure. No delays are accepted by the company. In case of delay, even with a valid ticket, the passenger will have no recourse against the company if unable to board. Only passengers who have reserved their seat and present a valid ticket are authorized to board. The ticket must be kept in good condition by the passenger throughout the journey.
Accessibility
Bicycles, strollers (even when folded), motorcycle equipment, or other bulky items are not allowed on board.
Passengers with Disabilities:
Access on board is not possible due to inaccessible port facilities for safe boarding or disembarking, as well as the dimensions of the ship's access doors, making it physically impossible to board electric, mechanical, or manual wheelchairs.
In case of non-disclosure at the time of booking, the Captain has the authority to refuse boarding to passengers whose disability is not compatible with the excursion without any requirement for reimbursement or compensation from the passenger.
Article 7: Safety and Liability
Safety Recommendations
Minors are allowed on board if accompanied by their parents and remain under their full responsibility. To ensure everyone's safety, passengers are requested to follow the captain's instructions during boarding, disembarking, and throughout the journey.
For your safety, passengers are advised to be aware of the particular behavior of a ship at sea, which may have platform movements. It is recommended to limit movement on board the ships. Parents are responsible for the behavior and safety of their children and must ensure they do not run on board, climb on railings, boxes, seats, or lifeboats.
Smoking or vaping is strictly prohibited on the deck, toilets, or any enclosed space of the ship. Passengers are prohibited from carrying flammable, explosive, or dangerous materials, firearms or knives, consuming alcohol or drugs on board. The Company is free to take measures to prevent such actions and undertake any necessary legal actions.
The company's personnel may refuse to sell a ticket, and the ship's Captain may refuse boarding and transportation to anyone whose behavior could endanger public order or the safety of other passengers. Passengers must be respectful towards ground personnel and the captain. The captain asks passengers for responsible behavior: avoiding risky situations, supervising and guiding their children on the boarding platform and on board, moving carefully on the ship, which is inherently different from land facilities, protecting their personal belongings from potential spray, being attentive to safety announcements, and following the captain's instructions.
Personal Items
Neither the company nor the captain is responsible for passengers' personal belongings on board. The company is also not responsible for the theft, loss, or damage of cash, documents, jewelry, or other items brought by passengers due to natural movements of the ship, sea conditions, or other factors. No compensation, refund, or indemnity will be provided by the company in case of theft, loss, or damage to personal belongings.
Swimming
The company is not a diving or snorkeling club. However, it offers swimming breaks during its excursions. Swimming is not mandatory and is done at the passengers' own risk. Passengers must be able to swim. The captain reserves the right to cancel a swimming break based on weather conditions.
Stops
The captain may propose stops to passengers during excursions. Neither the company nor the captain are responsible for passengers and their personal effects during these stops. No loan of swimming equipment is provided during these stops.
The company cannot be held responsible for any difficulties encountered by passengers in a shop or establishment during the stop.
The captain informs passengers of the end time of the stop and the return to the ship. Passengers must be present in front of the ship 5 minutes before the departure time given by the captain. No refund or compensation can be demanded by a passenger who could not board due to delay.
Responsibility
The captain is the sole master on board his ship and is solely authorized to judge whether weather conditions permit the excursion to take place and informs passengers of the safety instructions to follow.
During boarding, disembarking, as well as during coastal crossings and cruises, the responsibility of the company is limited at all times to the period during which passengers are under its direct control on board its ship, excluding all installations and structures belonging to the public domain.
Neither the Captain nor the Company can be held responsible for diversion, modifications, interruptions of services, or delays in the departure and arrival of the ship, nor for discrepancies in the arrival, departure, or connections of ships, airplanes, and trains.
The liability of the Company can only be engaged within the framework of the applicable maritime transport regulations. The compensations that can be allocated are limited by these regulations.
Article 8: Specific Conditions, Groups, Agreement, and Privatization.
Group: is defined as a 'group' of paying individuals traveling together and subject to a single booking and payment. The quote engages the reference person, and if any member fails to show up for boarding, the reservation will be due in full.
Upon receipt of the quote, a mandatory deposit of 50% of the total amount of the service is required for validation.
Privatization: refers to a service to have the vessel with skipper, for half a day or a full day. Depending on your preferences, a route will be defined in advance, and a fuel package will be included in the price of the service for a specified duration and a predefined navigation area.
Full payment of the total amount is required to confirm the reservation. Payment of the total amount of the service must be made no later than 05 days before departure.
Group and Privatization Refund: In case of cancellation by the group or the contracting party of the service, a full refund will be made by the company if it occurs 72 hours before the departure date, otherwise the service will be due in full. In the event of cancellation by the company, the service will be refunded in full.
Under no circumstances can the group, individuals, or the reference person evade the entirety of the company's Terms and Conditions.
Article 9: Ship Regulations
The company's vessel is subject to European regulations regarding passenger transport as well as Division 241, which confirms the vessel's compliance with technical standards for the safety of commercial pleasure craft with a hull length of 24 meters or less.
The captain holds a Master's Certificate and Chief Engineer's Certificate. These certificates also require possession of a first aid training certificate and a GOC (General Operator's Certificate) for radio operations.
Every crew member is required to undergo an annual physical fitness examination conducted by a maritime medical practitioner. Special insurance covers all passengers.
The company reserves the right, at the discretion of the Captain and for reasons inherent in navigation, to make stops other than those planned or to modify the initial route. The captain is permitted to tow, provide assistance to vessels in all situations, divert, conduct all rescues and all transfers, with passengers waiving any claims in this regard.
In accordance with Article 241-4.01 of Division 241 of French maritime safety regulations, the company is required to establish a register of passengers on board, including the name, first name, and age category of each passenger or child under one year old.
Article 10: Complaints
Any complaint against the company must be made within 15 days from the date of the excursion, by registered letter with acknowledgment of receipt to the headquarters of the company SARL Altu Mare, Résidence Pietra Rossa Building A Chemin d’Uccini 20600 BASTIA.
Article 11: Applicable Jurisdiction
Any dispute arising from the application of these general transport conditions will be under the sole jurisdiction of the commercial court of Bastia. French law is the only applicable law.
